Please read these Terms and Conditions carefully before using Our Service.
These Terms of Service (the “Terms”) govern your access to and use of the Momentum Screener website and services (the “Service”). By creating an account, starting a trial, or using the Service in any way, you agree to be bound by these Terms.
1. Who we are
Momentum Screener LLC (the “Company,” “we,” “us,” or “our”), c/o Northwest Registered Agent, LLC, 1846 E. Innovation Park Dr., STE 100, Oro Valley, AZ, 85755, USA, provides an online investment research platform focused on long-term stock momentum trends. We do not provide brokerage services, we do not execute trades, and we do not provide individualized investment advice.
2. Eligibility
You must be at least 16 years old to use the Service. If you are using the Service on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
3. Account registration
To use most features, you must create an account using an email address (or supported OAuth providers such as Google or Microsoft). OAuth sign-in is used only for identity / authentication, not for marketing or social features.
You are responsible for all activity that occurs under your account. Keep your credentials secure. If you believe your account has been compromised, notify us promptly at [email protected].
4. Trials and subscriptions
We may offer a free or discounted trial (for example, a 60-day free trial) to let you evaluate the Service. The specific terms of your trial (length, features, and what happens at the end) will be shown at sign-up.
Unless stated otherwise, when your trial ends, your account may:
- Automatically convert to a paid subscription and bill the payment method you provided, or
- Fall back to a limited/free tier with reduced features.
You authorize us (via Paddle, our merchant of record) to begin billing automatically when the trial ends unless you cancel before then.
5. Payments and billing (via Paddle)
We use Paddle as our merchant of record and payment processor. When you purchase a subscription, Paddle will collect and process your payment information (including billing country and ZIP/postal code) in its own hosted checkout. We do not store full payment card details on our servers.
By purchasing a subscription, you agree to pay all applicable fees shown to you at checkout and you authorize Paddle to charge your payment method on a recurring basis (monthly or annually, as selected) until you cancel.
Prices, taxes, and billing intervals are shown at the time of purchase. Paddle may collect and remit taxes depending on your location.
5.1 Auto-renewal
Subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date. You can manage or cancel your subscription through the Paddle customer portal link we provide or by contacting us.
5.2 Refunds
We may issue refunds or credits on a case-by-case basis, but we are not obligated to do so. For billing questions, contact [email protected].
6. Your license to use the Service
As long as you follow these Terms and pay any applicable fees, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your own internal or personal investment research.
You may not:
- Resell, redistribute, or publicly share our rankings, proprietary momentum data, or UI screens as a competing service.
- Use automated tools to scrape or mass-export data from the Service.
- Bypass or attempt to bypass subscription / feature gating.
7. User content and saved settings
If the Service allows you to create favorites, watchlists, or saved settings, you grant us permission to store and process that data for the purpose of providing the Service back to you. We do not claim ownership over your lists, but we may remove or restrict content that violates these Terms or applicable law.
8. No investment, financial, or tax advice
The Service provides data, tools, and rankings for informational and educational purposes only. We do not guarantee that any particular stock, ETF, or other instrument will perform in any way. We do not consider your personal financial situation, risk tolerance, or objectives.
Nothing on the Service is investment, financial, or tax advice. You are solely responsible for your investment decisions. You should consult a qualified financial professional before making any investment decisions.
9. Availability and third-party services
We try to keep the Service online and up to date, but we do not guarantee 100% uptime. The Service may be unavailable due to maintenance, infrastructure issues, or outages affecting third parties (for example: Paddle or OAuth providers like Google or Microsoft).
We are not responsible for failures caused by:
- OAuth providers refusing or delaying authentication;
- Paddle declining payments or requiring additional verification;
- Your own network, browser, or device configuration.
10. Privacy
Your use of the Service is also governed by our Privacy Policy. Please review it to understand what data we collect, how we use it, and your rights. If these Terms conflict with the Privacy Policy on a data-processing point, the Privacy Policy will control.
11. Intellectual property
All content, features, designs, text, graphics, code, and compilation on the Service are owned by us or our licensors and are protected by copyright and other laws. You receive only the rights expressly granted in these Terms.
12. Termination
We may suspend or terminate your access to the Service if:
- You fail to pay subscription fees;
- You breach these Terms (for example, scraping or sharing proprietary data);
- We are required to do so by law or by a third-party provider we depend on.
You may stop using the Service at any time. If you want to delete your account, follow the in-app instructions or contact us. Note: If you have an active subscription when you delete your account, we will automatically contact Paddle to cancel the subscription on your behalf. Any unused portion of a paid subscription will not be refunded.
13. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the data or rankings in the Service are accurate, complete, current, or suitable for actual trading decisions. Market data can change rapidly.
14. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, consequential, exemplary, incidental, or punitive damages, or for any loss of profits or revenues, even if we have been advised of the possibility of such damages, arising out of or related to your use of the Service.
Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us (via Paddle) for the Service in the 3 months immediately preceding the event giving rise to the claim.
15. Governing law
These Terms will be governed by and construed in accordance with the laws of the State of Arizona, U.S.A., without regard to its conflict-of-laws rules.
16. Changes to these Terms
We may update these Terms from time to time to reflect changes in the Service, in pricing, or in applicable law. When we make material changes, we will update the “Effective date” at the top and, where reasonable, notify you via the Service or by email. Your continued use of the Service after the changes become effective constitutes your acceptance of the new Terms.
